JYJ sues Dispatch for defamation of character

After creating controversy with the release of their report and audio files detailing the alleged swearing and violence against sasaeng fans by the JYJ members, Dispatch has been sued by JYJ for defamation of character.

According to reports that have surfaced, JYJ’s representatives are said to have filed a lawsuit against Dispatch asking for 100 million KRW (~$88,355 USD) on August 1st KST. It is also reported that they have demanded that Dispatch take down the audio files and their article, or be fined with 3 million KRW (~$2,650 USD) each day that the media outlet does not comply. One report also mentioned that the representatives stated that Dispatch had threatened to release more reports if they were not granted an exclusive interview.

JYJ’s legal team stated, “Publicly revealing an illegally recorded audio file without confirming with those involved first and revealing their real names is considered to be defamation of character and a violation of privacy.”

“We had previously filed a criminal case back in March. However, after discussion, we thought that a civil lawsuit was a better fit, and thus retracted the previous lawsuit and refiled again.”

that was the same thing I was questioning. Isn't the purpose of this type of lawsuit to sue someone for making something up to defame you? Not just releasing things that actually happened?

there has been quite a bit of discussion that the audios are cut/ parts of it are taken from JJ's drama
and that the video of Yoochun is actually reversed by an anti..

idk i guess we'll find out after the hearing?

i think if the reports/articles are not true, they can sue for libel. and because the audio was procured illegally, they're suing them for defamation of character and violation of privacy instead. like technically, those audio files have no merit, because you're not supposed to record someone without their consent. but in dispatch posting them, it is assumed that they are trying to smear their reputation.

i'm not a lawyer, though, so i could be wrong.

I wish they would deal with this differently.

And to the people wondering why are they suing if that's them in the audios, is because apparently the audio was altered (the parts were you hear the slapping sounds and hitting), and they have proof of a video provided by a fan. I don't know if it's going to be released to the public though, I guess more articles will come out in the next few days.

That situation makes me feel really conflicted but I hate how poorly JYJ and CJeS managed it.

JYJ never say the audio is fake though. They are suing dispatch for releasing it without confirmation and mention Kim Jaejoong name in their article. Especially since it just audio without any pics and the fans record it without JJ consent.

JYJ has issued their apologize, and JJ admit that it was his voice.

There's a rules for this. That's why you have news mention person A or B (although we know it for sure who the person is)... And dispatch just broke it.

Idt cjes need to do this, but seeing dispacth track record on JYJ, I see why they do.. Also a nice warning to sasaeng to leave them alone.
