They could probably still use images of JYJ, cause technically JYJ are still with them as they haven't won yet (and they are using JYJ to advertise their academy), but I think it would be illegal to use images of Hangeng as he is no longer signed to SM.

Yes, they can use their images and those of any former SME artist, perfectly legally, if they own the copyright on the images or have licensed them from a third-party copyright holder and if they have the appropriate model release documentation in place when the foootage was filmed.

I loved this song! I should have the album stashed somewhere in my room, makes me want to go dig it out. I adore the current SMTOWN line-up, but this makes me a bit nostalgic for the first generation. :') The only people in this version who were also in 2002's original SMTOWN version are BoA and Kangta! Makes me feel old watching this MV when I remember watching the Christmas version ten years ago, omg. :((((((( And speaking of the original, it sounds like they didn't bother to re-record BoA's adlibs for the 2012 version and just used her adlibs from the original, lol. And yayy for the EXO boys being included!

I loved SMTOWN albums, I miss them. :( The last Christmas album didn't even have a joint song, which I always felt was the point of a company album. :P Maybe in the summer they can remake Summer Vacation, haha. Although it's going to be hard to squeeze everyone in unless they do what they did here and just give parts to the main singers of each group. Or give everyone 3 second parts.

Why wouldn't it be legal? I can't see the vid because I'm in work, but copyright on the images lies with the creator of the image - i.e. the film-maker or photographer - not with the subject of the image. I expect they will have signed blanket model releases when they were with the company, allowing the company and authorised third-parties to film them and use those images commercially. These won't be voided by the contract disputes. So, if they agreed to be filmed at the time, the owner of the copyright on the footage can do what they like with it.

It's like saying SM can no longer sell old DBSK CDs because JYJ are on the cover art or show SuJu vids that include Geng. Of course they can.

p.s. credentials - copyright and image licensing is part of my job.

While I understand your frustration (none of the 5 SM girls I follow were included) . . . the only group that had more than one member singing was HoMin. I'm pretty sure that EXO had one each from M and K (correct me if I'm wrong), and then they included the first singer from all of the other active/popular groups.

In other words, they left out not only Zhou Mi, Wookie, and Kyuhyun, but Onew/Taemin, Seohyun/Jessica/Tiffany, Krystal, Zhang Liyin, Isak, Jay and Lina/Dana for vocal lines and solo artists, almost all of whom were featured in older group songs.

Granted, Zhou Mi wasn't featured even when Wookie and Kyu were, which really wasn't fair, but they also just have more artists than they know what to do with.

CRYING!!! My Baby BoA's last note... so beautiful. Brought tears to my eyes. Legit. Dare to dream that they'll sing Dear My Family as the finale song in Anaheim? Not that I don't LOVE Hope (HOT FAN FOR LIFE!), but of ALL the SM family songs, Dear My Family is my favorite. I remember the first time I watched the classic video and was just overwhelmed with how great it was.

As for the images of people who are no longer with the company, if you notice, they blocked out the faces of SOME people, but I'm going to presume that SM has the rights to use the images of people who WERE with the company as long as the images/footage come from the time that they were under SM's contract.

Side note: Loved the Isak and Jiyeon album cover in the background. Memories.
