Today, (Sept, 27th) Han Geng’s current Compant Le Hua Ent sent a statement and the legal documentations confirming Han Geng and SM’s exclusive contract dispute ended in the voiding of the exclusive contract.

In regards to the Seoul High Court case number 2011-13014 in regards to the case of the validity of the exclusive contract, Han Geng and SM has reached an amicable mutual agreement. Ending in Han Geng filing a “Notice of Appeal Withdrawal”.
Han Geng will continue activities in China like usual, there are no plans for any Korean activities yet.

Date: 2011-09-27 07:03 am (UTC)I am a little annoyed at the backlash on Tumblr. A lot of SJ fans are saying they were stupid because they 'promised to believe' and Hangeng ended up leaving. I'll quickly state how I feel about fans saying they "miss" Hangeng. He didn't die, he didn't disappear from the planet. He was just his own act. There's nothing to miss because he never vanished from the music industry. I'm happy this matter is behind him :)

1.解除与sm的合约 - Termination of Contract with SME
2.专属合同无效的诉讼 - Declaration of Invalidity of Exclusive Contract with SME
On December 21st 2010 he won the first lawsuit, and SME subsequently decided to appeal.
What Han Geng withdrew is the second lawsuit, the one that’s asking to declare the contract invalid.
About the mutual agreement that is reached on the case side pretty much it means that SME will drop their appeal on the 1st case, and Han Geng will withdraw the 2nd lawsuit. Although we don’t know the specific terms of the mutual agreement here’s what we know, Han Geng is now a free agent as SME released him from his exclusive contract as his team stated, and SME saves face and likely a hefy legal expense that would have been payable to Han Geng.
Now that I’ve calmed down and thought about it, I do believe that this is the BEST CASE SCENARIO. Think about it, at this point in Han Geng’s career anyone can see that he is taking his acting career very seriously and is rising up in the ranks extremely fast. One thing about major Chinese movies is that they are almost all realeased in Korea, and a portion of major movies involve some form of collaboration with Korea. Seeing what SME is doing to JYJ, if this drags on it can possibly have a negative affect on his movie career. I mean the industry is competitive enough, if Han Geng always have a “not welcome in Korea” sign following him, it really limits his choices. I think this is paving way for his return to Korea. So, Han Geng wins in he gets his freedom and eliminates on possible negative impact on him as he advance in his acting career and SME gets to establish that they are still influencial and gets to use this as a warning bell to others who are thinking about sueing — he went to another country and still had to settle with us etc.
In this industry, there are no such thing as enemies forever or friends forever. I probably wouldn’t even be suprised if there’s a provision in the mutual agreement that says something on the lines of Han Geng will give preferencial consideration to SME on future Korean promotions or stuff like that.
If I want ppl to walk away from this long rant with one thing it’s that the lawsuit is over, and the contracts are void. Let’s continue to follow him on his journey and see where it leads us, no?

Han Geng recently filed for a dismissal of SM's appeal.
This article states that Han Geng has now withdrawn his appeal, and settled outside of court with SM. This means that SM has also withdrawn their appeal, and the lawsuit is completely over.
Everything is done, and Han Geng has no ties to SM, nor does he have to pay out contract termination fees.
