After reporting on January 7 about MOMOLAND member Daisy’s statement that the show “Finding MOMOLAND” was rigged, KBS has shared further allegations from the artist.
KBS reported that the reason Daisy had come to their reporters was that she has been in conflict with her agency MLD Entertainment for a long time. Because of this, she had requested the termination of her contract with the company, however the agency demanded a large penalty for a breach of contract in return.
KBS described how in March 2019, MOMOLAND returned but with a smaller lineup. Daisy did not take part in the comeback for personal reasons.
She expressed her desire to promote again starting in May, but she was not given any opportunities for eight months after this.
Daisy said to KBS, “I told them that I thought I could [promote] but they kept saying to me, ‘No, it would be good if you rested.'”
KBS reports that she requested a termination of her contract, but the agency demanded a penalty of 1.1 billion won (approximately $943,330). On what’s known as a standard contract, it states that if an artist breaks the contract, they have to pay a penalty beyond compensation for damages.
KBS advisory lawyer Yang Seung Kook stated, “[The agency] has to prove that they carried out their duties properly, that the artist aims to unilaterally break their contract, and that they have really violated their contract.”
This standard contract protocol was put in place in 2009 with the intention of preventing unfair contracts between agencies and artists, however there have been criticisms of it. KBS reports that while it’s the duty of an agency to secure activities for an artist, if they do not do so, there are no ways of disciplining the agency, and the protocol also allows for a system of unfair costs being passed on to the artist.
MLD’s representative has said that it is up to the company to decide whether or not a member promotes and that they notified Daisy of the penalty because her side first revealed her desire to withdraw.

Date: 2020-01-07 03:24 pm (UTC)Her mom and her legal advisors are capitalising on the current environment and this is a masterful stroke of genius in terms of negotiating out of a shitty contract.
Kudos to her.
Rip them apart Daisy!

Date: 2020-01-07 03:37 pm (UTC)I applaud Daisy for being so public about it, and picking this timing too. She's doing what she can to get out of this contract. I really hope it works out for her, and for everyone still signed with MLD ent, I feel so bad for them :(

Date: 2020-01-07 03:59 pm (UTC)- however, she was later added to the group for their 1st comeback
- according to what daisy is saying now, she was assured immediately after her elimination that she would be joining the group later on, and therefore the competition was rigged
- daisy stayed with the group for several comebacks, but she went on hiatus for unknown reasons after "baam"
- she is now saying that she wanted to come off hiatus and rejoin the group but the company wouldn't let her, they told her "just rest"
- she then tried to get out of her contract but they claimed she'd have to pay this ridiculous termination fee

Date: 2020-01-08 04:40 am (UTC)Also idk sbout Korean law but MLD should be the one held in breach not Daisy even if Daisy asked to terminate the contract first because MLD's actions basically amount to constructive dismissal (AKA essentially forcing Daisy to ask for termination because they weren't giving her any work/income-producing opportunities).

Date: 2020-01-08 04:44 am (UTC)The music execs prob have "planning" meetings at golf clubs, spas, fancy restaurants and bill it to the group as an expense so they don't have to pay shit-all to their artists.
Kudos to those agencies that split revenues before break-even, but idk how common that is.
