B.A.P’s Himchan Indicted For Sexual Assault; Trial Date Set For July

B.A.P’s Himchan has been indicted without detention on charges of sexual assault.

Last year, Himchan was investigated by the police for allegedly assaulting a woman in her twenties (hereafter referred to as “A”) at a guest house in Namyangju. According to “A,” there had been three men and three women—including herself and Himchan—drinking together at the house at the time of the incident.

During the police’s investigations, “A” alleged, “I was sexually assaulted,” while Himchan denied the accusations, claiming, “We were both interested in each other.”

On June 25, it was revealed that Himchan had been indicted by the Seoul Central District Prosecutors’ Office on charges of sexual assault in April of this year.

According to a report by Yonhap News, Himchan’s trial will begin on July 12.

I hate this. I know how unlikely it is that there'll be hard evidence/witnesses so when they find him 'innocent' (not implying that he's guilty, just that this will be hard to prove) his stans will be insufferable. I'm exhausted listening to people slander the huge amount of women who unsuccessfully take men to trial due to sexual assault, just because their cases are so hard to prove and often result in 'innocent'.

Does anyone know if the fact that this is moving to trial means they might actually have a case against him, or do they do that regardless? I thought that I remember other cases (Yoochun for example) just being questioned and then the case was dismissed.

I just looked it up, and it appears the prosecutor has the case referred to them and they decide whether the case is strong enough to indict the defendant.

An indictment usually mean the prosecutor has enough to go to trial
If they lacked evidence they would have dropped it

SK is a civil law country so they should/might have the Principle of opportunity (but I'm not sure)
