SM Entertainment has filed an objection to the compulsory mediation decision made by the judge (acting as mediator) presiding over their ongoing legal battle with former EXO members Wu Yi Fan (Kris) and Luhan.

On June 4, SM has filed an objection to the Seoul Central District Court through their legal representative, stating that they cannot accept the compulsory arbitration. The reasoning behind their objection has yet to be revealed.

A compulsory mediation is when the court decides on a settlement between the plaintiff and the defendant when the two parties fail to reach a decision. If neither parties appeal to the court’s decision in two weeks, it becomes the final verdict. However, now that SM has objected to the court’s mediation decision, it has been nullified.

Wu Yi Fan and SM’s legal conflict started in May of last year, while Luhan took SM to court in October of last year. Both have demanded termination of their contract with the agency. Despite multiple meetings, the two sides have yet to reach a settlement.

After their leave, both Wu Yi Fan and Luhan continued to have successful careers in China. Regarding their activities, SM announced, “We are determined to stop illegal entertainment activities of Kris and Luhan, as well as make sure that no other companies are harmed like this,” adding, “the contract with Kris and Luhan will continue to be effective until the final decision is reached in court. Until then, all activities they undergo will be considered illegal, and we will make sure they are held accountable for their actions.”

tl;dr, from what i've gathered, sm making the first objection and krishan's side remaining silent means that the decision was likely in krishan's favour (both sides had two weeks to make an objection)

kris, luhan and essentially all of the chinese members were already successful before exo? i'm impressed at how popular and successful they are because i keep reading apparently exo isn't that big in china... or was exo-m gaining a lot of momentum but SM cockblocked them (at least this is what i gathered from tao's post yesterday). is SM that stupid and prideful and stupid?

Kris and Luhan had a small predebut following but managed to generate pretty big individual fandoms before SM trapped M in Korea. Their fandoms eventually spilled over to the mainstream without association with EXO...so basically they worked hard to develop M but their own popularity as individuals ended up surpassing EXO in the mainstream

I kind of dont get why sm is dragging this out.
With jyj they were using the lawsuit as an excuse to cockblock. Sm is not blocking any opportunities for krishan and as much as they like to call krishan's activities ~illegal~, it's not scaring anyone. At this point they're just wasting money. If the same judge is going to give very similar rulings on the final decision then why even bother? Pride? Scare tactic for future artists? If its the latter then that's pretty despicable

If I were SM, I drag it out too. This is common practice for big companies regarding lawsuits. Doesnt matter whether they will lose or win, they got money to burn until the other part emptied their pocket.

Second, if SM give up too easily, it could send the message to the public that SM perhaps was in the wrong.
Third, dragging the lawsuit create time for people to lose interest in the case; so if the verdict is negative, they'll just bury it. If it's positive, they can media-play it. It is much easier to create a ruckus than to quite one down.
Fourth, the lawsuit give great promotion opportunities for EXO. Sympathies, patriotism, racism...It paint EXO in pitiful light, it unites the broken Exo-L, it make the Korean public sympathize them.

And of course, the most obvious, like you said, is scare tactic. It sending the message that SM is not easy. They'll do whatever it takes if/when you cross them.

of course idk about korean law, but in cases of contract employment it is extremely unusual for judges to order performance of the contract because it regards personal services and courts have usually decide to terminate the contract to enable a clean break and also because of policy reasons, ordering performance by an ex-employee will just create a more hostile relationship.
