According to Chinese entertainment source Sina Entertainment, a representative from Luhan’s “Luhan’s Workshop” released an official statement on February 6 disputing the claims made in the lawsuit SM Entertainment filed against the singer and fellow ex-EXO member Kris.

The statement reads, “We are releasing this official statement in order to clarify the truth and and to protect Luhan’s reputation. SM has filed a lawsuit to the Shanghai courts claiming that ‘Luhan has been participating in activities in China without permission.’ However, according to the rules of jurisdiction, [SM] has no right to file a lawsuit about [Luhan’s] exclusive contract to a Chinese court. Indeed, the Shanghai courts have no jurisdiction [over this matter].”

It continues, “The results of [our] investigation show that SM sued an advertiser affiliated with Luhan for copyright infringement. This does not match up with the reasons that [SM] provided for their actions. The statement that SM released through the press is misleading. SM is aware of the reasons behind [Luhan] filing [for nullification] of his exclusive contract, but in their statement the company unethically said, that ‘[he left] without any legitimate reason.’ Saying that ‘[Luhan] left EXO without any reason other than his own gain’ is a malicious attempt to defame Luhan.”

The statement concludes with, “In order to protect his lawful rights and interests, we will take full legal measures against any reports that slander Luhan’s reputation”

Meanwhile, Luhan left SM Entertainment in October of last year and filed for nullification of his exclusive contract with the company. Luhan has since entered into two rounds of court mediations with SM Entertainment but to no avail. On February 5, SM Entertainment released an official statement that claimed that Luhan left EXO without permission and announced that the company had filed lawsuits against not only Luhan but also the advertisers that used him as a spokesperson.

Article: Luhan reps release statement on SM lawsuit, "Malicious intent"

Source: TV Report via Nate

1. [+561, -17] Hey kid, malicious intent is something SM should be saying to you. It's not something you deserve to say.

2. [+552, -20] SM better not let him off the hook, it'll only make more act up ㅋㅋ Hopefully SM wins

3. [+481, -17] Hope SM wins ㅋㅋ

4. [+26, -3] But who's the one who started the lawsuit...?

5. [+22, -0] Malicious intent??????? Did you forget what you did?

6. [+19, -1] At least Kris knows to stay quiet, all this bastard does is talk talk talk and threaten defamation when all SM is doing is talking about the truth. You're acting illegally ㅋㅋ You're promoting in China when the lawsuit's not even over.

7. [+15, -1] Then tell me, Luhan, what was your intent in backstabbing the group?

8. [+15, -0] Even animals know not to bite the hand that feeds them

-

Source: Naver

1. [+13,088, -808] Kris and Luhan are seriously the icons of betrayal. I don't like SM all that much but I hope they win. Anyone who still supports Kris and Luhan needs to wake up.

2. [+10,826, -580] You could have 10 mouths and not one of them would deserve to say anything

3. [+9,799, -437] Luhan, you seem to forget that you started this entire lawsuit with your own malicious intent

4. [+8,746, -508] No one asked you, shut up

5. [+1,139, -44] Of course it's malicious intent, did you expect them to coddle you after they invested so much in you and you just up and left like that? ㅋㅋㅋㅋ

6. [+1,093, -52] You're more malicious than SM

7. [+940, -46] SM is merely responding to malicious intent with malicious intent

[1358+] Those two will attend Spring Festival anyway~ If you have the ability, then try to fight with CCTV

[1326+] I hope that the various media stations and advertisers will respond strongly to this situation. Our own country, whichever celebrity we invite is our own business. There is no tolerance for a foreign company sticking their hands into our matters. If he comes good, if he doesn’t then goodbye. Who are you threatening? Like so more people can see!

[1101+] I just want to know, why are you so fucking arrogant. You’re also very derogatory towards us okay? If you have the ability to, keep going.

[966+] Fine, give up the Chinese market then.

[803+] Haha the only ones who co-operate with SM are sh*tty stations. Does SM really think they have everyone at their beck and call? Their Korean groups can’t even surpass the popularity of Korean actors. And now China has so many little fresh meats, who even cares about you? Right, Luhan and Wu Yi Fan are attending CCTV Spring Festival and SM can keep working with sh*tty stations.

[807+] Hateful Hunan, this treacherous station has been eating SM’s c*nt all this time. So weak and soft, why can’t they toughen up?

[721+] Baidu asked Luhan to endorse them, Tencent asked Wu Yi Fan. Dragon TV invited Luhan to NYE countdown, Zhejiang invited Wu Yi Fan. CCTV invited Luhan and Wu Yi Fan to attend the Spring Festival. Luhan has 2-3 endorsements, all with reputable companies. Wu Yi Fan has 3-4, including Tencent, Kang Shi Fu Deng and other domestic sites. Many huge stations are all working with the two. And EXO? After WYF and Luhan terminated, they only have KFC and Hunan TV. What does this tell you?

[570+] Great, finally we don’t need to see SM anymore. Not a Luhan/Kris fan, just believe that Chinese people shouldn’t be bullied like this.

[487+] This is the sound of SM kicking themselves out of China.

[472+] No in depth co-operation huh. You’re drunk, SM you think way too highly of yourselves.

[438+] Don’t come digging for gold in China then. When have you ever invited a Chinese actor over to Korea? And you then talk about the same stage? China, don’t invite Koreans anymore.

[392+] You want to bully Chinese kids on Chinese territory? SM’s pretty brave...

Glorious!!! XD

I was just in the process of making an update post lol.
So my interpretation: This was never about SM blocking KrisHan's 'illegal activities' and their statement was a shitload of nonsense. Firstly, if this was about them working while still technically under contract to SM than SM would've filed in Korea not Shanghai.Kris hasn't even been sued, he has nothing to do with this.
SM is only suing KanS for using photos of Luhan from EXO era so this is a copyright infringement suit and is actually SM v KanS.Luhan has nothing to do with this either, this is a fucking fine or slap on the wrist type lawsuit. The companies stated in the lawsuit are the parent ones who own KanS
Some people were saying this is bc Kris/Luhan were still technically under contract to Nature Republic.Again false since both are endorsing cosmetic brands and Kris hasn't been touched.Additionally if SM were seriously trying to stop them working in Chian, they'd have gone after Tencent,Baidu,Lancome etc and they haven't.
The talk of temporary injunctions is going on.I think it's very likely both boys filed for those since I doubt companies would contract them if they weren't legally allowed too + Kris wouldn't be gallivanting across China promoting his movie if he wasn't allowed
TL;DR, SM threatens to huff and puff and blow the house down but all they did was some piss-poor TPing.

Yeah, I just don't understand the logic...it's beyond stupid and shooting themselves in the foot. That c-netizen's comment - "This is the sound of SM kicking themselves out of China" - is so accurate.

I can only conclude that they've been driven mad by their hate boner for those that step out of line and "betray" them, and their actions are thus no longer governed by rationality or foresight. If I was an investor in SM's stock, this behavior would be really worrying to me.

I think they are trying to get back their rep with investors. It's not doing very well. And doing the us vs them of a different nation culture will rope in some powerful men who might dislike China and will help them out. Just a theory. Because their logic for a business is really...

From: [identity profile] leighbee333.livejournal.com
Wait, so SM is blatantly lying in their statement and acting as if they're going after Luhan & Kris for "illegal activities" when really they're merely going after KanS for copyright infringement? Good God, that's pathetic.

Why would they lie about something that's so easily proven false when fact-checked? Is the Korean media that compromised by nationalism that SM feels they can be depended on to downplay stuff like this for them?

SM stans are so fucking short sighted, I mean I love EXO to death but we all know that sm especially is terrible for working groups to death and then discarding them when they are no longer raking in money. They've forgotten how SM treated Hangeng and the fact that he still worked in China while in the process of leaving SM, like I honestly thought EXO would be different since it's their second time around, but nope, EXO M got the short end of the stick and then when people leave suddenly they're traitors~. Luhan was starting to look like a zombie when he left, and if I haqd fans as batshit insane as exo-l's can be I'd get the fuck out of Korea as well.

sm has every right to sue kans for using pics from other cfs/copyright infringment, but using this lawsuit to spew nonsense about krishan's" illegal activities" and attempting to threaten these companies crossing the line and just makes them look stupid when they have their temporary injunction and are free to do as they wish

i continue to be confused with and unsettled with the rationality behind the "biting the hand that feeds you," just because you debuted under a company, you are forever indebted to said company and have no right to leave if you don't agree with it?

argue all you want about the timing, but that kind of borderline abusive rhetoric is completely idiotic. kris and lu han and the like have all the right to attempt to terminate contracts and leave companies they no longer feel comfortable working with anymore period

This. I cannot wrap my head around that idea. Just because they signed a contract does not mean they have to out up with shit they don't like. If I sign up for a 2 year cellphone contract and they start being a shitty company after a year you bet your ass I'm breaking the contract and leaving.

Biting the hand that feeds you my ass. Even animals will attack the hand that feeds them if they're continually abused.

Kris, Luhan, and all the other ex-SM artists who couldn't handle the lack of security regarding sasaengs, hell, SM's relying heavily and therefore encouraging sasaeng behaviour, and the working conditions that turn them into wraiths aren't obligated to continue working for SM if they don't want to put up with it anymore. Acting like SM is a benevolent caretaker who got backstabbed is bullshit.
